**第一項**  適用事業所に使用される七十歳以上の者であつて、老齢厚生年金、国民年金法による老齢基礎年金その他の老齢又は退職を支給事由とする年金たる給付であつて政令で定める給付の受給権を有しないもの（第十二条各号に該当する者を除く。）は、第九条の規定にかかわらず、実施機関に申し出て、被保険者となることができる。
