  **第一項**  裁判所は、家事調停事件について、次の各号のいずれかに該当するときは、管轄権を有する。

    **一**  当該調停を求める事項についての訴訟事件又は家事審判事件について日本の裁判所が管轄権を有するとき。

  **第二項**  民事訴訟法第三条の七第二項及び第三項の規定は、前項第三号の合意について準用する。

  The provisions of Article 3-7, paragraphs (2) and (3) of the Code of Civil Procedure apply mutatis mutandis to the agreement referred to in item (iii) of the preceding paragraph.

  **第三項**  人事訴訟法（平成十五年法律第百九号）第二条に規定する人事に関する訴え（離婚及び離縁の訴えを除く。）を提起することができる事項についての調停事件については、第一項（第二号及び第三号に係る部分に限る。）の規定は、適用しない。
