**第一項**  著作権、出版権又は著作隣接権の侵害に係る訴訟において、損害が生じたことが認められる場合において、損害額を立証するために必要な事実を立証することが当該事実の性質上極めて困難であるときは、裁判所は、口頭弁論の全趣旨及び証拠調べの結果に基づき、相当な損害額を認定することができる。

When damage is found to have been incurred in litigation involving infringement of a copyright, print rights, or neighboring rights, if, due to the nature of the relevant facts, it is extremely difficult to prove the facts that are necessary for proving the amount of damage, the court may approve a reasonable amount of damage based on the overall gist of oral proceedings and the results of the examination of evidence.
