**第一項**  旧根抵当権で、極度額についての定めが新法の規定に適合していないものについては、元本の確定前に限り、その定めを変更して新法の規定に適合するものとすることができる。この場合においては、後順位の抵当権者その他の第三者の承諾を得ることを要しない。
