        **第一項**  弁済の提供は、債務の本旨に従って現実にしなければならない。ただし、債権者があらかじめその受領を拒み、又は債務の履行について債権者の行為を要するときは、弁済の準備をしたことを通知してその受領の催告をすれば足りる。

        The tender of the performance must be made actually consistent with the main purport of the obligation; provided, however, that if the obligee refuses to accept that performance in advance or if any act is required on the part of the obligee with respect to the performance of the obligation, it is sufficient for the obligor to request its acceptance by giving a notice that the tender of the performance has been prepared.
