**第一項**  仲裁手続において使用する言語及びその言語を使用して行うべき手続は、当事者が合意により定めるところによる。

The languages to be used in an arbitration procedure and the procedures to be carried out by using those languages are as provided by the agreement of the parties.

**第二項**  前項の合意がないときは、仲裁廷が、仲裁手続において使用する言語及びその言語を使用して行うべき手続を定める。

If an agreement referred to in the preceding paragraph has not been reached, the arbitral tribunal determines the languages to be used in the arbitration procedure and the procedures to be carried out by using those languages.

**第三項**  第一項の合意又は前項の決定において、定められた言語を使用して行うべき手続についての定めがないときは、その言語を使用して行うべき手続は、次に掲げるものとする。

If the agreement referred to in paragraph (1) or the determination referred to in the preceding paragraph does not provide for the procedures to be carried out by using the languages specified, the procedures to be carried out by using those languages are to be as follows:

  **三**  仲裁廷が行う書面による決定（仲裁判断を含む。）又は通知

  decision (including an arbitral award) or notice in writing by the arbitral tribunal.

**第四項**  仲裁廷は、すべての証拠書類について、第一項の合意又は第二項の決定により定められた言語（翻訳文について使用すべき言語の定めがある場合にあっては、当該言語）による翻訳文を添付することを命ずることができる。

An arbitral tribunal may order that any documentary evidence is to be accompanied by a translation into the languages provided by the agreement referred to in paragraph (1) or determination referred to in paragraph (2) (or if the languages to be used for a translation are provided, into the languages).
