### 第百八条の四（指定講習機関） — (Designated Training Institutions)

**第一項**  公安委員会は、次の各号に掲げる講習を、それぞれ当該各号に定める要件に該当すると認められるものとして指定する者（以下「指定講習機関」という。）に行わせることができる。

A public safety commission may have the training set forth in one of the following items conducted by a person it designates as one that is found to meet the requirements set forth in the relevant item (hereinafter referred to as a "designated training institution"):

  **一**  第百八条の二第一項第二号に掲げる講習（以下この条及び次条第一項において「取消処分者講習」という。）　自動車等の運転に必要な適性に関する調査及びこれに基づく指導（以下「運転適性指導」という。）について専門的知識を有する者として国家公安委員会規則で定める者（第三号及び次条において「運転適性指導員」という。）が置かれていることその他取消処分者講習を適正かつ確実に行うために必要なものとして国家公安委員会規則で定める基準に適合すること。

  the training set forth in Article 108-2, paragraph (1), item (ii) (hereinafter referred to in this Article and paragraph (1) of the following Article as "training for persons stripped of driving privileges"):one that employs a person that the Rules of the National Public Safety Commission prescribe as having expert knowledge in testing persons for the competence necessary for driving a motor vehicle or motorized bicycle and in giving instruction based on this (hereinafter referred to as "instruction in competent driving") (referred to as a "driving competency instructor" in item (iii) and the following Article) and that otherwise meets the criteria that the Rules of the National Public Safety Commission prescribe as being necessary for an institution to meet in order to conduct training for persons stripped of driving privileges in a proper and reliable manner;

  **二**  初心運転者講習　自動車等の運転に必要な技能及び知識に関する指導（次条において「運転習熟指導」という。）について高度の能力を有する者として国家公安委員会規則で定める者（同条において「運転習熟指導員」という。）が置かれていることその他初心運転者講習を適正かつ確実に行うために必要なものとして国家公安委員会規則で定める基準に適合すること。

**第二項**  前項の規定による指定は、取消処分者講習、初心運転者講習又は若年運転者講習（以下「特定講習」という。）を行おうとする者の申請により行う。

**第三項**  次の各号のいずれかに該当する者は、第一項の規定による指定を受けることができない。

  one other than a general incorporated association, general incorporated foundation, or designated driving school;

  **二**  第百八条の十一第一項又は第二項の規定により指定を取り消され、その取消しの日から起算して二年を経過しない者

  one whose designation has been revoked pursuant to paragraph (1) or (2) of Article 108-11, if it has been less than two years since the date of that revocation;

  **三**  自動車等の運転に関し自動車の運転により人を死傷させる行為等の処罰に関する法律第二条から第六条までの罪又はこの法律に規定する罪を犯し拘禁刑以上の刑に処せられ、その執行を終わり、又はその執行を受けることがなくなつた日から起算して二年を経過しない者

**第四項**  公安委員会は、第一項の規定による指定をしたときは、当該指定に係る特定講習を行わないことができる。
