**第一項** この法律の施行の際現に介護保険法（平成九年法律第百二十三号）第八条第十一項に規定する特定施設に入居している者（生活保護法第十五条の二第二項に規定する特定施設入居者生活介護を同項に規定する居宅介護を行う者に委託し、又は同条第五項に規定する介護予防特定施設入居者生活介護を同項に規定する介護予防を行う者に委託して行っている場合において、これらの介護扶助を受けている者を除く。）については、第三条の規定による改正後の生活保護法第八十四条の三の規定は、適用しない。

With regard to a person who, at the time this Act comes into effect, is actually residing in a specified facility prescribed in Article 8, paragraph (11) of the Long-Term Care Insurance Act (Act No. 123 of 1997) (excluding a person receiving such long-term care assistance in a case where the care services provided in specified facilities prescribed in Article 15-2, paragraph (2) of the Public Assistance Act are entrusted to a person providing the in-home care services prescribed in that paragraph, or the care services for care prevention provided in specified facilities prescribed in paragraph (5) of that Article are entrusted to a person providing the care prevention services prescribed in that paragraph), the provisions of Article 84-3 of the Public Assistance Act as amended by the provisions of Article 3 do not apply.
