**第一項**  不実の申請その他不正な手段により保護を受け、又は他人をして受けさせた者は、三年以下の拘禁刑又は百万円以下の罰金に処する。ただし、刑法（明治四十年法律第四十五号）に正条があるときは、刑法による。
