> 前項の規定による即時抗告が人事訴訟に関する手続を不当に遅延させることを目的としてされたものであると認められるときは、原裁判所は、その即時抗告を却下しなければならない。

English (Japanese Law Translation, Ministry of Justice):

> If it is found that the immediate appeal under the provisions of the preceding paragraph has been filed for the purpose of unjustly delaying personal status litigation procedures, the court of first instance must dismiss it.
