**第一項** 次の各号に掲げる行為の区分に応じ、当該各号に定める者は、その委託を行った電子決済手段・暗号資産サービス仲介業者が当該各号に掲げる行為につき利用者に加えた損害を賠償する責任を負う。ただし、当該各号に定める者がその電子決済手段・暗号資産サービス仲介業者への委託につき相当の注意をし、かつ、その者の行う電子決済手段・暗号資産仲介行為につき利用者に加えた損害の発生の防止に努めたときは、この限りでない。

The person specified in each of the following items in accordance with the category of acts set forth in that item is liable to compensate for any loss or damage that the electronic payment instruments and cryptoasset intermediary service provider that entrusted the act has caused to users in relation to the act set forth in that item; provided, however, that this does not apply if the person specified in that item has exercised reasonable care in entrusting the act to that electronic payment instruments and cryptoasset intermediary service provider and has endeavored to prevent the occurrence of loss or damage caused to users in relation to the electronic payment instruments and cryptoasset intermediary acts carried out by that person.
