**第一項**  次の各号のいずれかに該当する者は、三年以下の拘禁刑若しくは百万円以下の罰金に処し、又はこれを併科する。

**第二項**  前項第一号の罪を犯した者が、医師又はこれに類似した名称を用いたものであるときは、三年以下の拘禁刑若しくは二百万円以下の罰金に処し、又はこれを併科する。
