**第一項**  この省令は、昭和四十三年四月一日から施行する。

**第四項**  休業補償の額の改定に係るこの省令の施行の日から昭和四十三年十二月三十一日までの間における事業場の規模については、前項の規定による改正後の労働基準法施行規則（以下「新規則」という。）第三十八条の二の規定を適用して算定した同年十月一日から昭和四十四年六月三十日までの間の各四半期における休業補償の額が、前項の規定による改正前の労働基準法施行規則第三十八条の二の規定の適用があるとして算定した当該四半期における休業補償の額に満たない場合には、新規則第三十八条の二の規定にかかわらず、なお従前の例による。

With regard to the size of a workplace during the period from the date on which this Ministerial Order comes into effect with respect to the revision of the amount of compensation for absence from work until December 31, 1968, if the amount of compensation for absence from work for each quarter during the period from October 1 of that year until June 30, 1969, calculated by applying the provisions of Article 38-2 of the Ordinance for Enforcement of the Labor Standards Act after the amendment under the provisions of the preceding paragraph (hereinafter referred to as the "new Rules"), is less than the amount of compensation for absence from work for that quarter calculated on the assumption that the provisions of Article 38-2 of the Ordinance for Enforcement of the Labor Standards Act before the amendment under the provisions of the preceding paragraph apply, the provisions then in force continue to govern, notwithstanding the provisions of Article 38-2 of the New Rules.
