### 第六条の二

**第一項**  法第十八条第二項、法第二十四条第一項ただし書、法第三十二条の二第一項、法第三十二条の三第一項、法第三十二条の四第一項及び第二項、法第三十二条の五第一項、法第三十四条第二項ただし書、法第三十六条第一項、第八項及び第九項、法第三十七条第三項、法第三十八条の二第二項、法第三十八条の三第一項、法第三十八条の四第二項第一号（法第四十一条の二第三項において準用する場合を含む。）、法第三十九条第四項、第六項及び第九項ただし書並びに法第九十条第一項に規定する労働者の過半数を代表する者（以下この条において「過半数代表者」という。）は、次の各号のいずれにも該当する者とする。

The person representing a majority of the workers (hereinafter referred to as "a representative of the majority of the workers" in this Article) prescribed in paragraph (2) of Article 18, the proviso of paragraph (1) of Article 24, paragraph (1) of Article 32-2, paragraph (1) of Article 32-3, paragraphs (1) and (2) of Article 32-4, paragraph (1) of Article 32-5, the proviso of paragraph (2) of Article 34, paragraphs (1), (8), and (9) of Article 36, paragraph (3) of Article 37, paragraph (2) of Article 38-2, paragraph (1) of Article 38-3, item (i) of paragraph (2) of Article 38-4 (including as applied mutatis mutandis pursuant to paragraph (3) of Article 41-2), paragraphs (4), (6), and the proviso of paragraph (9) of Article 39, and paragraph (1) of Article 90 of the Act shall be a person who falls under all of the following items:
