### 第一条（施行期日） — Effective Date

**第一項**  当該労働者に支給すべき介護補償給付に係る障害補償年金又は傷病補償年金の支給事由となる障害の原因となる負傷又は疾病に関する療養を開始した日が施行日前である場合（施行日の前日において当該労働者が炭鉱災害による一酸化炭素中毒症に関する特別措置法（昭和四十二年法律第九十二号）第八条第一項の規定による介護料を受ける権利を有していたときを除く。）における介護補償給付に関する第二条の規定による改正後の労働保険の保険料の徴収等に関する法律施行規則（以下「新徴収則」という。）第十八条第二項の規定の適用については、同項第五号中「の額」とあるのは「の額（当該介護補償給付に係る障害補償年金又は傷病補償年金の支給事由となる障害の原因となる負傷又は疾病に関する療養を開始した日が労働者災害補償保険法施行規則等の一部を改正する省令（平成八年労働省令第六号）の施行の日前である労働者に支給されたものについては、当該介護補償給付が支給されなかつたものとみなした場合の額）」とする。

In the case where the date on which medical treatment commenced for the injury or illness causing the disability that constitutes the ground for payment of the disability compensation pension or illness or injury compensation pension pertaining to the nursing care compensation benefit to be paid to the worker concerned is before the Effective Date (excluding the case where, on the day preceding the Effective Date, the worker concerned had the right to receive the nursing care allowance under Article 8, paragraph (1) of the Act on Special Measures concerning Carbon Monoxide Poisoning Caused by Coal Mine Accidents (Act No. 92 of 1967)), with regard to the application of Article 18, paragraph (2) of the Ordinance for Enforcement of the Act on the Collection, etc. of Insurance Premiums of Labor Insurance as amended by Article 2 (hereinafter referred to as the "new Labor Insurance Premium Collection Ordinance") to the nursing care compensation benefit, in item (v) of that paragraph, "amounts" is deemed to be replaced with "amounts (for a benefit paid to a worker for whom the date on which medical treatment commenced for the injury or illness causing the disability that constitutes the ground for payment of the disability compensation pension or illness or injury compensation pension pertaining to the nursing care compensation benefit is before the effective date of the Ministerial Order Partially Amending the Ordinance for Enforcement of the Industrial Accident Compensation Insurance Act, etc. (Order of the Ministry of Labour No. 6 of 1996), the amount in the case where that nursing care compensation benefit is deemed not to have been paid)".

**第一項**  第二条の規定の施行の際現に労災保険に係る保険関係が成立している事業であって事業の期間が予定されているものについての概算保険料を延納することができる場合における当該概算保険料の額に係る要件については、新徴収則第二十八条第一項の規定にかかわらず、なお従前の例による。
