**第一項**  法第十二条第三項の厚生労働省令で定める保険給付は、療養補償給付、休業補償給付、介護補償給付及び労働者災害補償保険法施行規則（昭和三十年労働省令第二十二号。以下「労災則」という。）第四十六条の二十第三項、第五項、第七項又は第八項（労災則第四十六条の二十四及び第四十六条の二十五の三において準用する場合を含む。）の規定により給付基礎日額を算定した特別加入者（労働者災害補償保険法（昭和二十二年法律第五十号。以下「労災保険法」という。）第三十三条各号に掲げる者をいう。以下この条において同じ。）に関し支給する保険給付とする。
