**第一項** この省令の施行の際現に法別表第一の四の表の研修の在留資格をもって在留する外国人（出入国管理及び難民認定法第七条第一項第二号の基準を定める省令の一部を改正する省令（平成二十一年法務省令第五十号）附則第三条第一号及び第二号に掲げる場合を除く。）は、第二条第八号の適用については、技能実習の在留資格（法別表第一の二の表の技能実習の項の下欄第一号ロに係るものに限る。）をもって本邦に在留する技能実習生とみなす。
