**第一項**  当分の間、特定適用事業所以外の適用事業所（健康保険法第三条第三項に規定する適用事業所をいい、国又は地方公共団体の当該適用事業所を除く。以下この条において同じ。）に使用される第一号又は第二号に掲げる者であって同法第三条第一項各号のいずれにも該当しないもの（前条の規定により同項（第九号に係る部分に限る。）の規定が適用されない者を除く。以下この条において「特定四分の三未満短時間労働者」という。）については、同項並びに同法附則第八条の三の二第二項及び第四項の規定にかかわらず、健康保険の被保険者としない。

For the time being, a person listed in item (i) or (ii) who is employed at an applicable place of business other than a specified applicable place of business (meaning an applicable place of business prescribed in Article 3, paragraph (3) of the Health Insurance Act, excluding such an applicable place of business of the national government or a local government; the same applies hereinafter in this Article) and who does not fall under any of the items of paragraph (1) of that Article (excluding a person to whom the provisions of that paragraph (limited to the part pertaining to item (ix)) do not apply pursuant to the preceding Article; hereinafter in this Article referred to as a "specified under-three-quarters part-time worker") is not to be an insured person covered by health insurance, notwithstanding that paragraph and Article 8-3-2, paragraphs (2) and (4) of the Supplementary Provisions of that Act.

**第二項**  特定適用事業所に該当しなくなった適用事業所に使用される特定四分の三未満短時間労働者については、前項の規定は、適用しない。ただし、当該適用事業所の事業主が、次の各号に掲げる場合に応じ、当該各号に定める同意を得て、保険者等（全国健康保険協会が管掌する健康保険にあっては厚生労働大臣、健康保険組合が管掌する健康保険にあっては当該健康保険組合をいう。以下この条において同じ。）に当該特定四分の三未満短時間労働者について同項の規定の適用を受ける旨の申出をした場合は、この限りでない。

The provisions of the preceding paragraph do not apply to a specified under-three-quarters part-time worker employed at an applicable place of business that has ceased to be a specified applicable place of business; provided, however, that this does not apply if the employer of that applicable place of business has, in accordance with the cases listed in the following items, obtained the consent specified respectively in those items and made a request to the insurer, etc. (meaning the Minister of Health, Labour and Welfare in the case of health insurance administered by the Japan Health Insurance Association, and the health insurance society in the case of health insurance administered by a health insurance society; the same applies hereinafter in this Article) to the effect that the provisions of that paragraph are to apply to that specified under-three-quarters part-time worker.

**第七項**  第五項の申出があったときは、当該特定四分の三未満短時間労働者については、当該申出が受理された日以後においては、第一項の規定は、適用しない。この場合において、当該特定四分の三未満短時間労働者についての健康保険法第三十五条の規定の適用については、同条中「適用事業所に使用されるに至った日若しくはその使用される事業所が適用事業所となった日又は第三条第一項ただし書の規定に該当しなくなった」とあるのは、「公的年金制度の財政基盤及び最低保障機能の強化等のための国民年金法等の一部を改正する法律（平成二十四年法律第六十二号）附則第四十六条第五項の申出が受理された」とする。

In this case, with respect to the application of the provisions of Article 35 of the Health Insurance Act to that specified under-three-quarters part-time worker, the phrase "the day on which the person has become an employee of an applicable place of business, the day on which the place of business employing the person has become an applicable place of business, or the day on which the provisions of the proviso to Article 3, paragraph (1) are no longer applicable" in that Article is deemed to be replaced with "the day on which the request under Article 46, paragraph (5) of the Supplementary Provisions of the Act Partially Amending the National Pension Act, etc. to Strengthen, etc. the Financial Basis and Minimum Guarantee Function of the Public Pension System (Act No. 62 of 2012) has been accepted".
