**第一項** この法律の施行の際現に老人保健法第四十六条の五の二第一項に規定する指定老人訪問看護事業者であるものについては、新健保法の施行日に、新健保法第四十四条ノ四第一項の指定訪問看護事業者の指定があったものとみなす。ただし、その指定老人訪問看護事業を行う者が施行日の前日までに、厚生省令の定めるところにより別段の申出をしたときは、この限りでない。

With regard to a person who, at the time this Act comes into effect, is a designated home-nursing provider for the elderly prescribed in Article 46-5-2, paragraph (1) of the Act on Health and Medical Services for the Elderly, the designation of a designated home-nursing provider under Article 44-4, paragraph (1) of the Revised Health Insurance Act is deemed to have been made on the Effective Date of the Revised Health Insurance Act; provided, however, that this does not apply if the person conducting that business of designated home nursing for the elderly has notified otherwise, as provided by Ministry of Health and Welfare Order, by the day before the Effective Date.
