    **第一項**  診療所又は薬局が医師若しくは歯科医師又は薬剤師の開設したものであり、かつ、当該開設者（医療法第三十条の十八の六第六項の規定による都道府県知事の要請を受け、これに応じなかった者を除く。）である医師若しくは歯科医師又は薬剤師のみが診療又は調剤に従事している場合において、当該医師若しくは歯科医師又は薬剤師について第六十四条の登録があったときは、当該診療所又は薬局について、第六十三条第三項第一号の指定があったものとみなす。ただし、当該診療所又は薬局が、第六十五条第三項又は第四項に規定する要件に該当する場合であって厚生労働大臣が同号の指定があったものとみなすことが不適当と認められるときは、この限りでない。

    In the case where a clinic or pharmacy has been established by a physician, dentist or pharmacist, and only the establisher (excluding a person who received a request from the prefectural governor under Article 30-18-6, paragraph (6) of the Medical Care Act but did not comply with it) who is that physician, dentist or pharmacist is engaged in medical care or prescription, if a registration under Article 64 has been made with respect to the physician, dentist or pharmacist, it is deemed that a designation referred to in Article 63, paragraph (3), item (i) has been made with regard to the clinic or pharmacy; provided, however, this does not apply when the clinic or pharmacy meets the requirements prescribed in Article 65, paragraph (3) or (4) but the Minister of Health, Labour and Welfare finds it inappropriate to deem that the designation referred to in Article 63, paragraph (3), item (i) has been made.
