  **第一項**  第三十八条第一項の対象障害者である職員の数の算定に当たつては、同条第三項及び第五項の規定にかかわらず、重度身体障害者、重度知的障害者又は精神障害者である特定短時間勤務職員（短時間勤務職員のうち、一週間の勤務時間が厚生労働大臣の定める時間の範囲内にある職員をいう。）は、その一人をもつて、第四十三条第五項の厚生労働省令で定める数に満たない範囲内において厚生労働省令で定める数の対象障害者である職員に相当するものとみなす。

  In calculating the number of qualifying disabled employees referred to in Article 38, paragraph (1), notwithstanding the provisions of paragraphs (3) and (5) of that Article, each specified employee working reduced hours (meaning an employee working reduced hours whose weekly working hours are within the range of the hours specified by the Minister of Health, Labour and Welfare) who is a person with a severe physical disability, a person with a severe intellectual disability, or a person with a mental disability is deemed to constitute the number of qualifying disabled employees provided for by Order of the Ministry of Health, Labour and Welfare, to the extent that this does not reach the number provided for by Order of the Ministry of Health, Labour and Welfare referred to in Article 43, paragraph (5).
