### 第二条（雇用保険法施行規則の一部改正等に伴う経過措置） — Transitional Measures Accompanying the Partial Amendment, Etc. of the Ordinance for Enforcement of the Employment Insurance Act

**第一項**  地域雇用開発等促進法の一部を改正する法律（以下「改正法」という。）附則第二条第一項に規定する雇用開発促進地域又はみなし地域（以下「雇用開発促進地域等」という。）であって次の各号のいずれにも該当するものについては、当該雇用開発促進地域等に係る同項に規定するみなし指定期間（当該期間が改正法による改正後の地域雇用開発等促進法（以下「新法」という。）第二条第二項後段の規定により延長され、又は短縮された場合においては、当該延長され、又は短縮された期間。次項において「みなし指定期間」という。）の末日までの間、第二条の規定による改正後の雇用保険法施行規則（以下「新規則」という。）第百十二条第二項の規定は、適用しない。

With regard to an employment development promotion area or deemed area prescribed in Article 2, paragraph (1) of the Supplementary Provisions of the Act Partially Amending the Act on Promotion of Regional Employment Development, etc. (hereinafter referred to as the "Amending Act") (such areas are hereinafter referred to as "employment development promotion areas, etc.") that falls under each of the following items, the provisions of Article 112, paragraph (2) of the Ordinance for Enforcement of the Employment Insurance Act as amended by the provisions of Article 2 (hereinafter referred to as the "New Ordinance") do not apply until the last day of the deemed designation period prescribed in Article 2, paragraph (1) of the Supplementary Provisions of the Amending Act pertaining to those employment development promotion areas, etc. (in the case where that period is extended or shortened pursuant to the provisions of the latter part of Article 2, paragraph (2) of the Act on Promotion of Regional Employment Development, etc. as amended by the Amending Act (hereinafter referred to as the "New Act"), the period as so extended or shortened; referred to as the "deemed designation period" in the following paragraph).

**第一項**  地域雇用開発等促進法の一部を改正する法律の施行に伴う関係政令の整備に関する政令（平成三年政令第二百四十二号。以下「整備令」という。）の施行の際現に改正法による改正前の地域雇用開発等促進法第十七条において読み替えて適用する雇用保険法（昭和四十九年法律第百十六号）第二十三条第二項に規定する個別延長給付を受けている者であって、整備令附則第三項の規定により改正法附則第二条第一項に規定するみなし指定期間を短縮した地域に係るもの（当該地域を当該短縮後の期間の末日（以下「満了日」という。）の翌日から整備令の施行の日の前日から起算して九十日を経過した日（以下「経過日」という。）までの間について新法第二条第一項第三号に規定する特定雇用機会増大促進地域とみなして新法を適用することとした場合において、同項第九号に規定する特定雇用機会増大促進地域離職者に該当することとなる者に限る。）については、満了日の翌日から経過日までの間、新法第二条第一項第九号に規定する特定雇用機会増大促進地域離職者とみなして新法第十七条の規定を適用する。

With regard to a person who, at the time of enforcement of the Cabinet Order on the Arrangement of Related Cabinet Orders Accompanying the Enforcement of the Act Partially Amending the Act on Promotion of Regional Employment Development, etc. (Cabinet Order No. 242 of 1991; hereinafter referred to as the "Arrangement Order"), is actually receiving the individual extended benefits prescribed in Article 23, paragraph (2) of the Employment Insurance Act (Act No. 116 of 1974) as applied by replacing terms under Article 17 of the Act on Promotion of Regional Employment Development, etc. before amendment by the Amending Act, and who pertains to an area for which the deemed designation period prescribed in Article 2, paragraph (1) of the Supplementary Provisions of the Amending Act has been shortened pursuant to paragraph (3) of the Supplementary Provisions of the Arrangement Order (limited to a person who would come to fall under a person separated from a specified employment opportunity expansion promotion area prescribed in Article 2, paragraph (1), item (ix) of the New Act where the New Act is applied by deeming that area to be a specified employment opportunity expansion promotion area prescribed in item (iii) of that paragraph of the New Act for the period from the day following the last day of the period after that shortening (hereinafter referred to as the "expiry date") until the day on which 90 days have passed counting from the day preceding the day of enforcement of the Arrangement Order (hereinafter referred to as the "lapse date")), the provisions of Article 17 of the New Act are applied, for the period from the day following the expiry date until the lapse date, by deeming that person to be a person separated from a specified employment opportunity expansion promotion area prescribed in Article 2, paragraph (1), item (ix) of the New Act.
