**第一項**  改正前の雇用保険法施行規則（以下「旧規則」という。）第百十三条第一項第一号の規定に基づき労働大臣が指定した業種及び同項第二号の規定に基づき当該業種ごとに労働大臣が定めた期間は、それぞれ改正後の雇用保険法施行規則（以下「新規則」という。）第百二条の三第一項第一号の規定に基づき労働大臣が指定した業種及び同項第二号の規定に基づき当該業種ごとに労働大臣が定めた期間とみなす。

The industries designated by the Minister of Labour pursuant to the provisions of Article 113, paragraph (1), item (i) of the Ordinance for Enforcement of the Employment Insurance Act before amendment (hereinafter referred to as the "Former Ordinance") and the periods determined by the Minister of Labour for each such industry pursuant to the provisions of item (ii) of that paragraph are deemed to be, respectively, the industries designated by the Minister of Labour pursuant to the provisions of Article 102-3, paragraph (1), item (i) of the Ordinance for Enforcement of the Employment Insurance Act after amendment (hereinafter referred to as the "New Ordinance") and the periods determined by the Minister of Labour for each such industry pursuant to the provisions of item (ii) of that paragraph.

**第二項**  新規則第百二条の三第三項の規定の適用については、この省令の施行の日（以下「施行日」という。）前に行われた休業であつて、旧規則第百十二条の雇用調整給付金（以下「旧雇用調整給付金」という。）が支給されるものは、新規則第百二条の二の雇用調整給付金（以下「新雇用調整給付金」という。）が支給される休業とみなす。

For the application of the provisions of Article 102-3, paragraph (3) of the New Ordinance, leave conducted before the day on which this Ministerial Order comes into effect (hereinafter referred to as the "Effective Date") for which the employment adjustment benefit under Article 112 of the Former Ordinance (hereinafter referred to as the "former employment adjustment benefit") is paid is deemed to be leave for which the employment adjustment benefit under Article 102-2 of the New Ordinance (hereinafter referred to as the "new employment adjustment benefit") is paid.
