**第一項** 偽りその他不正の行為により雇用調整助成金その他の法第四章の規定により支給される給付金の支給を受けた事業主又は事業主団体若しくはその連合団体がある場合には、都道府県労働局長は、その者に対して、支給した給付金の全部又は一部を返還することを命ずることができ、また、当該偽りその他不正の行為により支給を受けた第百二十条に規定する雇用関係助成金及び第百三十九条の四第一項に規定する雇用関係助成金については、当該返還を命ずる額の二割に相当する額以下の金額を納付することを命ずることができる。

Where there is an employer, or an employers' organization or a federation thereof, that has received, by deception or other wrongful acts, an employment adjustment grant or any other benefit paid under the provisions of Chapter IV of the Act, the Director of the Prefectural Labor Bureau may order that person to return all or part of the benefit paid and, with regard to the employment-related grants prescribed in Article 120 and the employment-related grants prescribed in Article 139-4, paragraph (1) that were received by that deception or other wrongful acts, may order that person to pay an amount not exceeding an amount equivalent to 2/10 of the amount ordered to be returned.

**第二項** 前項の場合において、代理人等又は訓練機関が偽りの届出、報告、証明等をしたため同項の規定による雇用関係助成金が支給されたものであるときは、都道府県労働局長は、その代理人等又は訓練機関に対し、その支給を受けた者と連帯して、同項の規定による雇用関係助成金の返還又は納付を命ぜられた金額の納付をすることを命ずることができる。
