**第一項**  厚生年金保険法附則第八条の規定による老齢厚生年金（附則第十八条、第十九条第一項から第五項まで、第二十条第一項から第五項まで又は前条第一項から第五項まで及び同法附則第九条の規定によりその額が計算されているものに限る。）の受給権者が厚生年金保険の被保険者（前月以前の月に属する日から引き続き当該被保険者の資格を有する者に限る。）である日（同法第四十六条第一項に規定する厚生労働省令で定める日を除く。附則第二十三条第一項並びに第二十六条第一項、第三項、第八項、第十一項及び第十三項において「被保険者である日」という。）又は国会議員若しくは地方公共団体の議会の議員（前月以前の月に属する日から引き続き当該国会議員又は地方公共団体の議会の議員である者に限る。）である日（附則第二十四条第三項及び第四項において「被保険者等である日」という。）が属する月において、その者の総報酬月額相当額（同法第四十六条第一項に規定する総報酬月額相当額をいう。以下同じ。）と老齢厚生年金の額（附則第十八条第三項、第十九条第三項若しくは第五項、第二十条第三項若しくは第五項又は前条第三項若しくは第五項において準用する同法第四十四条第一項に規定する加給年金額を除く。以下この項において同じ。）を十二で除して得た額（以下この項において「基本月額」という。）との合計額が同法第四十六条第三項に規定する支給停止調整額（以下この項において「支給停止調整額」という。）を超えるときは、その月の分の当該老齢厚生年金について、総報酬月額相当額と基本月額との合計額から支給停止調整額を控除して得た額の二分の一に相当する額に十二を乗じて得た額（以下この項において「支給停止基準額」という。）に相当する部分の支給を停止する。ただし、支給停止基準額が老齢厚生年金の額以上であるときは、老齢厚生年金の全部の支給を停止するものとする。

If, in the month that includes the day on which a beneficiary of an employees' old-age pension under the provisions of Article 8 of the Supplementary Provisions of the Employees' Pension Insurance Act (limited to one whose amount is calculated pursuant to the provisions of Article 18, Article 19, paragraphs (1) through (5), Article 20, paragraphs (1) through (5) or paragraphs (1) through (5) of the preceding Article of the Supplementary Provisions and Article 9 of the Supplementary Provisions of that Act) is an insured under employees' pension insurance (limited to a person who has continuously held the status of that insured from a day in a month on or before the previous month; excluding the day specified by Order of the Ministry of Health, Labour and Welfare prescribed in Article 46, paragraph (1) of that Act; referred to as the "day on which the person is an insured" in Article 23, paragraph (1) and Article 26, paragraphs (1), (3), (8), (11) and (13) of the Supplementary Provisions) or is a member of the National Diet or a member of the assembly of a local government (limited to a person who has continuously been a member of the National Diet or a member of the assembly of a local government from a day in a month on or before the previous month; referred to as the "day on which the person is an insured, etc." in Article 24, paragraphs (3) and (4) of the Supplementary Provisions), the total of the person's amount equivalent to total monthly remuneration (meaning the amount equivalent to total monthly remuneration prescribed in Article 46, paragraph (1) of that Act; the same applies hereinafter) and the amount obtained by dividing the amount of the employees' old-age pension (excluding the additional amount of pension prescribed in Article 44, paragraph (1) of that Act as applied mutatis mutandis pursuant to Article 18, paragraph (3), Article 19, paragraph (3) or (5), Article 20, paragraph (3) or (5) or paragraph (3) or (5) of the preceding Article of the Supplementary Provisions; the same applies hereinafter in this paragraph) by twelve (hereinafter referred to as the "base monthly amount" in this paragraph) exceeds the amount of the adjustment for the suspension of payment prescribed in Article 46, paragraph (3) of that Act (hereinafter referred to as the "amount of the adjustment for the suspension of payment" in this paragraph), payment of that employees' old-age pension for that month is suspended for the portion equivalent to the amount obtained by multiplying by twelve the amount equivalent to one-half of the amount obtained by deducting the amount of the adjustment for the suspension of payment from the total of the amount equivalent to total monthly remuneration and the base monthly amount (hereinafter referred to as the "standard amount for a payment suspension" in this paragraph); provided, however, that if the standard amount for a payment suspension is equal to or greater than the amount of the employees' old-age pension, payment of the whole of the employees' old-age pension is to be suspended.
