**第一項**  法第七十八条の二第一項に規定する第一号改定者（以下この条において「第一号改定者」という。）及び同項に規定する第二号改定者（以下この条において「第二号改定者」という。）が異なる被保険者の種別に係る一の期間を有する者である場合であつて、第一号改定者又は第二号改定者が各号の厚生年金被保険者期間のうち二以上の被保険者の種別に係る被保険者であつた期間を有しない者であるときは、当該二以上の被保険者の種別に係る被保険者であつた期間を有しない者である第一号改定者又は第二号改定者を二以上の種別の被保険者であつた期間を有する者とみなして、法第七十八条の三十五の規定を適用する。

Where the person subject to a class I revision prescribed in Article 78-2, paragraph (1) of the Act (hereinafter referred to as the "person subject to a class I revision" in this Article) and the person subject to a class II revision prescribed in that paragraph (hereinafter referred to as the "person subject to a class II revision" in this Article) are persons who have a time in one category relating to different insured categories, and the person subject to a class I revision or the person subject to a class II revision is a person who does not have time as an insured person relating to two or more insured categories among the categories of EPI insured period, Article 78-35 of the Act is applied by deeming the person subject to a class I revision or the person subject to a class II revision who does not have time as an insured person relating to those two or more insured categories to be a person who has spent time as an insured person in two or more categories.
