### 第三条の十三の十一

**第一項**  第三条の十の二の規定は、法第七十八条の三十の規定による障害厚生年金及び法第七十八条の三十一の規定による障害手当金の受給権者が、その障害に係る障害認定日の属する月までに当該障害に係る傷病の初診日における被保険者の種別に係る被保険者期間を有しない場合について準用する。この場合において、第三条の十の二第二号中次の表の上欄に掲げる字句は、それぞれ同表の下欄に掲げる字句に読み替えるものとする。
被保険者期間に	法第七十八条の二十二に規定する各号の厚生年金被保険者期間のうち最も長い同条に規定する一の期間（当該一の期間が二以上ある場合は、次に掲げる順序による。）に

The provisions of Article 3-10-2 apply mutatis mutandis where a beneficiary of a disability employees' pension under Article 78-30 of the Act and a disability allowance under Article 78-31 of the Act has no insured period relating to the insured category on the day of initial examination for the injury or illness relating to the disability by the month that includes the day of disability assessment for the disability. In this case, the words listed in the left-hand column of the following table in Article 3-10-2, item (ii) are deemed to be replaced with the words listed in the right-hand column of the same table, respectively.

The provisions of Article 3-12 apply mutatis mutandis where the deceased insured person or person who was an insured person relating to a survivors' employees' pension under Article 78-32, paragraph (1) of the Act (limited to one paid by reason of falling under Article 58, paragraph (1), item (ii) or (iii) of the Act) has no insured period relating to the insured category on the day of initial examination prescribed in Article 58, paragraph (1), item (ii) of the Act or on the day of initial examination for the injury or illness relating to the disability that became the ground for payment of the disability employees' pension prescribed in item (iii) of that paragraph, by the month that includes the day of death.
