**第一項** 内閣総理大臣は、第百五条の規定による災害緊急事態の布告があつたときは、当該災害に係る緊急災害対策本部が既に設置されている場合を除き、第二十八条の二の規定により、緊急災害対策本部を設置するものとする。

When a state of emergency disaster has been declared under Article 105, unless headquarters for emergency disaster control have already been established related to the disaster, the Prime Minister is to establish headquarters for emergency disaster control pursuant to the provisions of Article 28-2.
