Half of the members other than the chair are named on the recommendation of the labor union (労働組合) organized by a majority of the workplace's workers or, where there is none, of the person representing a majority of them; this rule and the rule on who chairs give way so far as a collective agreement (労働協約) with such a union provides otherwise (Article 17, paragraphs (3) to (5), applied by Article 18, paragraph (4)). The employer must report an industrial physician's recommendations to it, or to a safety and health committee (安全衛生委員会) (Article 13, paragraph (6)). Where, taking into account a physician's or dentist's opinion after a medical checkup (健康診断), or a physician's opinion after face-to-face guidance (面接指導), the employer finds measures necessary, the appropriate measures the Act names include reporting that opinion to this committee, to a safety and health committee, or to a committee on improving working-hours arrangements (労働時間等設定改善委員会) (Article 66-5, paragraph (1), and Article 66-8, paragraph (5)).
