  **第一項**  請求の放棄又は認諾は、口頭弁論等の期日においてする。

  **第二項**  請求の放棄又は認諾をする旨の書面を提出した当事者が口頭弁論等の期日に出頭しないときは、裁判所又は受命裁判官若しくは受託裁判官は、その旨の陳述をしたものとみなすことができる。
