**第一項**  この法律の施行前に、新法第三百九十八条の二十第一項第一号に規定する申立て、同項第二号に規定する差押え、同項第三号に規定する競売手続の開始若しくは差押え又は同項第四号に規定する破産手続開始の決定があつた旧根抵当権で、担保すべき元本が確定していないものについては、この法律の施行の日にこれらの事由が生じたものとみなして、同項の規定を適用する。

With respect to a former revolving mortgage for which, before this Act comes into effect, there has been a petition prescribed in Article 398-20, paragraph (1), item (i) of the New Act, an attachment prescribed in item (ii) of that paragraph, the commencement of auction procedures or a seizure prescribed in item (iii) of that paragraph, or an order commencing bankruptcy proceeding prescribed in item (iv) of that paragraph, and for which the principal secured has not been fixed, that paragraph applies on the basis that those grounds arose on the day this Act comes into effect.
