    **第一項**  家庭裁判所は、補助開始の審判をするときは、職権で、補助人を選任する。

    The provisions of Article 843, paragraphs (2) through (4) and Article 844 through Article 847 apply mutatis mutandis to an assistant.

    **第三項**  補助人又はその代表する者と被補助人との利益が相反する行為については、補助人は、臨時補助人の選任を家庭裁判所に請求しなければならない。ただし、補助監督人がある場合は、この限りでない。

    If an action involves a conflict of interest between the assistant or person representing the assistant and the person under assistance, the assistant must request the family court to appoint a temporary assistant; provided, however, that this does not apply if there is an assistant supervisor.
