      **第一項**  配偶者のある者が未成年者を養子とするには、配偶者とともにしなければならない。ただし、配偶者の嫡出である子を養子とする場合又は配偶者がその意思を表示することができない場合は、この限りでない。

      In order for one spouse to adopt a minor the other spouse must do so as well; provided, however, that this does not apply with respect to one spouse's adoption of the child in wedlock of the other spouse, nor does it apply if the other spouse is incapable of manifesting an intention.
