        **第一項**  債権の目的が特定物の引渡しである場合において、契約その他の債権の発生原因及び取引上の社会通念に照らしてその引渡しをすべき時の品質を定めることができないときは、弁済をする者は、その引渡しをすべき時の現状でその物を引き渡さなければならない。

        If the subject of a claim is the delivery of a specific thing, and the quality of the thing may not be determined on the time when the delivery is due in light of the cause from which the claim has arisen such as a contract and common sense trading practices, the person that performs the obligation must deliver the thing on an "as-is" basis on the time when the delivery is due.
