  **第一項**  前条第一項の訴えが、同項の期間内に提起されなかったとき、又は却下されたときは、役員責任査定決定は、給付を命ずる確定判決と同一の効力を有する。

  If an action referred to in paragraph (1) of the preceding Article is not filed within the period referred to in that paragraph or is dismissed, the officers' liability assessment order has the same effect as the final and binding judgment to order performance.
