## 1. Before Act No. 53 of 2023

> 前項第五号に掲げる事由がある場合において、当該仲裁判断から同号に規定する事項に関する部分を区分することができるときは、当該部分及び当該仲裁判断のその他の部分をそれぞれ独立した仲裁判断とみなして、同項の規定を適用する。

English (Japanese Law Translation, Ministry of Justice):

> If the grounds stated in item (v) of the preceding paragraph exist, and the part concerning the matters provided for in that item can be separated from the other parts of the arbitral award, the relevant part and the other parts of the arbitral award are respectively deemed to be independent arbitral awards, and the provisions of the paragraph apply.
