> 当事者の数が二人であり、仲裁人の数が一人である場合において、第一項の合意がなく、かつ、当事者間に仲裁人の選任についての合意が成立しないときは、一方の当事者の申立てにより、裁判所が仲裁人を選任する。

English (Japanese Law Translation, Ministry of Justice):

> If there are two parties and one arbitrator, an agreement referred to in paragraph (1) has not been reached, and the parties are unable to reach an agreement for the appointment of the arbitrator, the court will appoint the arbitrator upon the petition of one of the parties.
